Abstract

ABSTRACT This study aims to examine the practice of Takko Binoto in Mandailing customary marriage among the Siraisan community in Padang Lawas, analyzed through the perspective of 'urf. This research focuses on three main discussions: first, the practice of Takko Binoto within the Siraisan community; second, the community's perceptions of the tradition; and third, an analysis of Takko Binoto based on 'urf principles. This is a qualitative field research. Primary data sources were obtained through direct observations and interviews with traditional leaders in Siraisan, while secondary data were sourced from relevant books and journals. Data collection techniques included engagement with traditional figures, observation, interviews, and documentation. The data analysis followed a process of data condensation, data display, and conclusion drawing/verification. The findings of this study reveal that: first, the Takko Binoto process begins with a formal request for permission from the man to the woman's parents, followed by a seclusion period of one to three days at the man’s residence. This stage concludes with family negotiations to agree upon an affordable dowry and marriage requirements. Second, the existence of this ancestral tradition is preserved through oral tradition mechanisms integrated into various formal and informal social interactions. Third, the Takko Binoto tradition is categorized as 'Urf Shahih (valid custom) because it prioritizes deliberation and family values through the Dalihan Na Tolu system to achieve communal benefit (maslahah). Since it is oriented towards a legitimate marriage and obtaining parental blessing, this practice does not contradict Islamic Law.
